Restricciones a las Exportaciones de REE impuestas por China en el marco de la OMC

Resumen

Esta investigación tiene por objetivo analizar la consistencia de las restricciones a las exportaciones de los Elementos Raros de la Tierra (REE) con las obligaciones impuestas por el Protocolo de Adhesión de China a la OMC, en relación con las excepciones generales de los apartados b) y g) del Artículo XX GATT. Todo ello en el marco de la OMC.

Para ello se realiza una descripción general de los REE, el rol de China como productor mundial, el desequilibrio entre la demanda y oferta mundial por los RE y las consecuencias de su extracción y procesamiento.

A continuación se analizan las restricciones a la exportación de REE impuestas por China, indicando la relación entre la constante modificación de éstas políticas industriales y los siguientes dos elementos: el desarrollo de las disputas ante el OSD y las consecuencias, tanto medioambientales como de desequilibrio de mercado, que China ha debido enfrentar. También se indican normas OMC en la materia y el importante rol que juega la jurisprudencia del OSD.

Luego se analiza la disputa China-REE ante el OSD. Al respecto se destaca la decisión del Grupo Especial respecto a la relación del Protocolo de Adhesión de China y los Acuerdos OMC, en contraste con la opinión minoritaria de uno de los panelistas.

Por último se analizaron las partes del Protocolo de Adhesión de China referentes a las restricción a las exportaciones de REE, las obligaciones OMC+ que implican y su relación con los demás Acuerdos OMC, concluyéndose la falta de claridad al respecto por parte de la normativa OMC.

Finalmente se concluye la inconsistencia de las restricciones a la exportación de REE con las obligaciones impuestas por el Protocolo de Adhesión de China a la OMC, en relación con las excepciones de los apartados b) y g) del Artículo XX GATT.

Abstract

This research aims to analyze the consistency of the Rare Earth Elements (REE) export restrictions with their obligations under China’s WTO Accession Protocol, in relation to the general exceptions of paragraphs b) and g) of Article XX GATT. All within the framework of the WTO.

For this we start with an overview of the REE, the role of China as a global producer, the imbalance between global demand and supply for REE and the consequences of its extraction and processing.

Next is the analysis of the REE export restrictions imposed by China, indicating the relationship between the constant modification of these industrial policies and the following two elements: the development of disputes before the DSB and the environmental and market imbalance consequences that China has faced. WTO rules in this area and the important role played by the precedents of the DSB are also indicated.

Later the China-REE dispute before the DSB is analyzed. In this regard the decision of the Panel is highlighted with respect to the relationship of China's Accession Protocol and the WTO agreements, in contrast to the minority opinion of one of the panelists.

Finally parts of the Protocol of Accession of China concerning REE export restrictions were analyzed, the WTO plus obligations involved and their relationship to other WTO agreements, concluding the lack of clarity of the WTO rules in this subject.

This work ends concluding the inconsistency of the REE export restrictions with the obligations imposed by China’s Accession Protocol to the WTO, in relation to the exceptions in paragraphs b) and g) of Article XX GATT.
